patrimony triples after the 2014 election:
Federal Revenue documents reveal that Senator Aécio Neves (PSDB)
patrimony tripled after the 2014 election, when he was defeated by Dilma Rousseff (PT). The jump was from R
$ 2.5 million in 2015 to R $ 8 million in 2016.
The growth is the result of a financial operation between Aécio and his
sister Andrea Neves involving shares that the senator held on a radio of
which he was a partner for six years.
The breach of fiscal confidentiality of the Toucan (as PSDB members are
known) was ordered by the Federal Supreme Court (STF) in a precautionary action
that runs parallel to the investigation in which Aécio asked R$ 2 million to the owner of the meatpacker JBS , JoesleyBatista.
Half of the resources
were traced by Patmos Operation, a deployment of Lava Jato Operation in the
STF, which led to the arrest of Andrea, Aecio's right-hand man when he was
governor of Minas Gerais state (2003-2010). She was released in June.
In the 2014 elections, Aécio told Electoral Court (TSE)
that his quota in the radio station was worth R $ 700,000, in the form
of a debt he kept with his former owner, his mother.
For two years, in 2014 and 2015, Aécio also declared
to the Revenue R $ 700 thousand, according to the copies of the Income Tax
declarations now with the STF.
In September 2016, Aécio decided to sell his shares to the other partner
on the radio, Andrea. In carrying out the operation, the senator declared
to the Revenue that they were worth R $ 6.6 million, almost ten times more than
a year before.
At the same time, Aécio's mother forgave the debt with her son. The
same R $ 6.6 million was declared by Andrea in her Income Tax – whose confidentiality was also broken by the STF.
Aécio stated that he sold his quotas
in 48 installments, including a first installment of R $ 380 thousand.
accounting expert heard by “Folha” said that a more detailed analysis of the
business on the radio imposes access to the issuer's balance sheets, to know
how the great valuation of the shares occurred in such a short space of
time. The PGR (Chief Prosecutor's Office) did not request the
breach of the issuer's fiscal secrecy. (2018/03/13 – Folha de São Paulo)
involves pros and cons., says TSE minister in debate on fake news:
With the fake news
under analysis because of the electoral period - and the discussion about
impeding them and how to do it -, Justice Tarcício Vieira , of the TSE
(Superior Electoral Court), said yesterday that a regulation on the subject
involves pros and cons. that accompanies the right to freedom of expression.
"We need to know to what extent we are willing to
work on such an open concept of freedom of expression or such a narrow concept,
with the pros and cons. corresponding to each of these positions," said at the event "Fake News and Democracy
" at the Law College of
the Getúlio Vargas Foundation in São Paulo.
The meeting participants, most in the area of law,
have not reached a consensus on how to create regulations that effectively
prevent the spread of false news and punish perpetrators without resorting to
measures that may sound like censorship .
For the TSE justice,
the task is difficult and the time is short, since the official deadline for
electoral propaganda begins on August 16, but the problem is already there.
Vieira mentioned the alleged foreign interference in Donald Trump's election in the United States
and said that some kind of control cannot be dispensed with.
"It is possible that in the name of an absolute freedom of
expression you can no longer control any kind of content, such as a right of
reply, advance political propaganda, electoral poll," he said.
"It is possible to tread this path, but recent
American experience shows that this is not the path that may deserve our
Although it is a fundamental right, in the opinion of
the magistrate, freedom of expression must be exercised with limits, as it can
embed crimes and contraventions. "You have no right to be

Barroso excludes corrupt politicians from Temer’s pardon and increases time to
In a new decision on the Christmas pardon signed
by President Michel Temer in December, STF (Federal Supreme Court) Justice Luís
Roberto Barroso explained yesterday the cases in which the decree is suspended,
due to unconstitutionality, and defined new requirements that the sections that
have not been suspended can be applied, such as the fulfillment of at least one
third of the sentence - the original text provided a fifth.
has ruled that white-collar crimes (such as embezzlement, corruption, influence
peddling, crimes against the national financial system and those provided for
in the Bidding Law, money laundering, concealment of property and criminal
organization) are out of reach of the pardon, and convicted persons who are not
paying fines imposed by the courts.
In these points, the decision
affirms to reinstate what had been suggested by the National Council of
Criminal and Penitentiary Politics and had not been accepted by Temer.
The justice also accepted a request
from the Chief Prosecutor's Office (PGR) and prohibited the pardon for cases in
which the prosecution is pending and for sentenced persons who have previously
benefited from the substitution of the custodial sentence for a restrictive of
The pardon can be applied in cases
of crimes without violence or serious threat, with two restrictions: that the
prisoner has served at least one-third of the sentence (compared to a fifth in
Temer's text) and that the sentence has been less than eight years (in the
original decree there was no limit).

excerpts from the pardon decree raised doubts about what was still valid, and
the criminal courts were not giving any benefit.

like guardians of the Constitution, it seems that they want to invent a new

do not see constitutional support for a STF minister, an STF judge, to set the

far as I know, the Christmas pardon is a prerogative of the President of the
Republic. I fear that this voluptuousness that seeks the degradation of the
prerogatives of the President has consequences harder than those that present

'We will not gently accept Lula's arrest', PT
PT leaders already admit that former President Luiz Inacio Lula da
Silva may be
arrested before Easter on April 1, and therefore decided to intensify the
campaign to charge the reaction of the militants in the streets. Opening a
public security seminar yesterday afternoon, PT president Gleisi Hoffmann said the party would go with Lula "to the
end" and will not accept the arrest.
"If they want to cheat, we'll face them,"
Gleisi said. "We will not gently accept Lula's
arrest." Soon after, however, the PT president pointed out that she
was not preaching any violent offensive. In January, the senator went so
far as to say that in order to arrest Lula, it would be necessary to "kill
"Before you question me, I'm not talking about a
revolution, but the militancy of our party and the movements that always fought
on our side will not accept it peacefully," she insisted.
Gleisi criticized what she called the
"inertia" of the Federal Supreme Court (STF) by failing to analyze
the legality of prisons in cases of conviction in second instance before all
legal remedies have been exhausted. "What they are doing with Lula is
something unprecedented in the history of the country and it violates the
constitution, and now it is going to be torn again by the inertia of the
Supreme Court not to decide something that is vital for society, and not just
for Lula, "attacked the PT president.
By the end of this
month the Regional Federal Court of the Fourth Region (TRF-4) will judge the
appeal filed by Lula betwee. The PT has no expectation of reversing the
sentence in that court. Lulas was sentenced to serve 12 years and a month in
prison for passive corruption and money laundering.
Friday, the Superior Court of Justice (STJ) denied the granting of preventive
habeas corpus requested by lawyers of the former president to avoid his arrest. Faced
with this scenario, the Lula's defense asks the Supreme Court to urgently judge
actions to guarantee the argument of the constitutional principle of the
presumption of innocence.
The PT's strategy
is still to register Lula's candidacy for the presidency on August 15, the last
day of the deadline set by the Electoral Law, even if he is imprisoned. In
that case, the party will insist that the former president is a political
None of the PT
leaders officially speaks in "Plan B" to replace Lula, but behind the
scenes, Haddad was again quoted for this mission, after the former governor of
Bahia Jaques Wagner was target of Police investigation in his home in Salvador,
in the wake of Operation Red Card. Wagner has always been the favorite of
Lula for the dispute to the Planalto Palace, if he is prevented from campaigning. In
recent days, the name of former foreign minister Celso Amorim, now PT's
pre-candidate for the Rio government, has also begun to circulate.
