Lula
STF (Supreme Court) decision goes beyond Lula and reaches anonymous across the country (November 11th)
Michele, 31, was not taken to the headlines. She did not have her name exalted in slogans or stamped on flags.
On the 7th, however, when she received the news that the Supreme Court ruled that the arrest after conviction in the second instance is unconstitutional, Michele "only knew how to cry." I was relieved. “I have my little ones and I only think about them,” he told Folha newspaper on Sunday (10).
' She was 27 when she fell in love with the water seller near her house. Later, he was arrested. She went to visit him in jail and, threatened, was forced to hand over 446 grams of hashish to an acquaintance of the then boyfriend. The destination of the order was the jail. She was caught earlier by the police.
Michele stayed for 18 days in the Public Prison Joaquim Ferreira de Souza, female unit of the Gericinó Penitentiary Complex, the Bangu 8 .
That year, 2014, she was unemployed and took care of her mother who was treating cancer. Michele already had three children, ages 6, 5 and 3.
Three years after the arrest, she was acquitted. At the time the judge considered the evidence null. The prosecution, however, appealed. In that analysis, Michele was convicted in the second instance and an arrest warrant was issued. It was her nightmare back.
Even with habeas corpus, obtained by the Public Defender's Office of Rio, she thought she could be arrested at any time and away from her children again.
Since Thursday, however, Michele is no longer afraid of going to the market next door. She knows she will have to pay for the mistake she made, but, like famous politicians, she will be able to respond to the lawsuit and try to prove that she has never been a drug dealer. Her defense asks that the penalty be reversed to provide services to the community.
Without the risk of surprise arrest, she makes plans: She wants to go to nursing school and get closer and closer to her children. These days, by the way, the oldest returned from school with the title of "conflict mediator". It was enough for her to dream of a career as a judge for the sapling.
"What I want most is to be free once and for all."

Lula begins trips around the country; petista is expected in Recife on Sunday (November 11th)
PT management prepares Lula's first trip to the Northeast. It will be on the 17th, to Recife, where the former president should attend the Lula Livre Festival. The show with artists such as Odair José and Marcelo Jeneci was already scheduled before the petista left prison.
The expectation now is that the event will be transformed into an act of celebration for the former president's freedom and that he will take the stage to thank and speak to the Northeastern people.
This Monday (11), Lula will speak with international political characters who celebrated his release from prison, such as US Senator Bernie Sanders and Alberto Fernández, newly elected president of Argentina.

In PT stronghold, Lula attacks Bolsonaro, focuses on the economy and talks about militia management (November 11th)
Returning on Saturday (9) to the PT stronghold of origin, the region of ABC Paulista, former President Luiz Inacio Lula da Silva, 74, made a harsh speech against Lava Jato Operation and former judge Sergio Moro, attacked the federal government's economic policy and referred to the administration of President Jair Bolsonaro (PSL) as militia.
Lula spoke on a sound truck in front of the headquarters of the ABC Metalworkers Union, in São Bernardo do Campo. It was there, in April 2018, that the former president made his last speech before surrendering himself to federal police officers and being taken to prison in Curitiba, where he spent 580 days.
Lula was released the day before, helped by a new understanding of the STF (Supreme Court) under which condemned the prison should occur only after the end of all resources. The petista, however, follows the Clean Record Law, which is prevented from competing in elections.
"I'm back," he said, to the applause of militants. "I have more courage to fight than when I left here."
Lula spoke offhand for 45 minutes. He called for resistance and unity from the left and set the mood for the 2022 elections. "The left will defeat the ultra-right that we both want to defeat."
The same day, in the morning, Bolsonaro had already attacked Lula, in a clash that should mark national politics in the coming years, with Moro also in this game, and the petista as a kind of opposition leader and main critic of the current economic policy.
Without mentioning the petista's name, Bolsonaro praised Moro's role in the Lava Jato Operation and urged his followers not to "give the bastard ammunition, who is momentarily free but guilty." Minutes later, also on a social network, Moro wrote that "fighting for justice and public safety is not an easy task" and that regrets the decision of the Supreme Court that allowed the release of Lula.
In addition to the post, Bolsonaro talked about the release of the petista. "The vast majority of the Brazilian people are honest, hardworking, and we will not make room or compromise with a convict. He is free, but still has all his crimes on his back."
In the afternoon, Lula responded and showed that he will oppose Bolsonaro not only in the political field, but also in the economic field. He criticized the reform agenda and said that liberalism in Chile, praised by Minister Paulo Guedes (Finance), has raised poverty in the neighboring country. He also called Guedes a "dream breaker."
In summoning the militancy, Lula referred to the Bolsonaro administration as militia . "It's no use being scared. It's no use being worried about the threats they make on television, which will have militia, which will have AI-5 again. We have to make the following decision: this country is 210 million inhabitants, and we cannot allow the militia to destroy this country we built. "
As Rio state deputado, Senator Flávio Bolsonaro, the president's son, employed in his office in the Legislative Assembly the mother and wife of a former police officer suspected of leading a militia in western Rio de Janeiro, accused of kidnapping, torturing and murdering people, as well as exploiting clandestine housing markets and extorting residents of underserved communities.
In addition, a series of speeches by the current president and his children point out that the Bolsonaro family has downplayed the severity of militia actions over the years — in addition to defending and extolling suspected criminals in these groups.
Bolsonaro, as a federal deputy, even criticized the CPI of the Militias, held by the Rio Assembly. He argued that some military police officers are mistaken for militia for organizing the security of their own community but do not engage in extortion.
This Saturday marked the meeting of Lula with petista leaders, other leftist parties, unions and social movements. In the sound truck, the petista was accompanied, among others, by the former mayor and former president Fernando Haddad, PT president Gleisi Hoffmann, Guilherme Boulos (MTST) and João Paulo Rodrigues (MST).
Last night, still in Curitiba, Lula met his former minister Jose Dirceu, also released after the decision of the Supreme Court and said that the fight is now to retake the government. Lula and Dirceu had last met in 2012.
At the ABC union, before starting the speech, the former president was greeted with shouts of "Lula, free." Faced with overcrowding around the union, some militants got sick and needed medical attention.
Thrilled, he said he was "afraid of lying to the working people" and repeated that his Lava Jato "tormentors" are lying in the lawsuits against him. The petist referred to the 15 m² room of the Federal Police in which he was imprisoned for 580 days as a "loner."
In dealing with his convictions, Lula called Moro a "scoundrel" - the minister of justice today was responsible for condemning the trial of the Guarujá triplex, which led to his arrest. He then said that Prosecutor Deltan Dallagnol set up a "gang" in charge of the Lava Jato task force.
Moro responded right away on a social network. "To those who ask me for answers to offenses, I clarify: I do not respond to criminals, arrested or released. Some people just deserve to be ignored."
In the ABC speech, Lula said he accepted the results of the 2018 elections, but that Bolsonaro was democratically elected to govern the country, not to the Rio de Janeiro militias. The petista also charged a "serious expertise" in the electronic system of the condominium concierge where Bolsonaro has a home in Rio.
In a statement already dismissed by the Rio Public Prosecution Service, a doorman said he heard from President Jair Bolsonaro, through the intercom, the authorization to enter the condominium car driven by one of the accused of the death of Councilwoman Marielle Franco, the same day of the crime, March 2018. Bolsonaro, however, was in the House that day while still acting as a federal deputy.
Lula even repeated his attacks on TV Globo. "You have no dimension of what today's means to me. Upstairs [looking up] is the Rede Globo Television helicopter to talk shit about Lula and us again." And even attacked other broadcasters. "Silvio Santos [SBT] TV is a shame, Record is a shame, and Globo remains the same shame."
In a statement, Globo replied: "Globo repudiates the attacks of former President Luiz Inacio Lula da Silva. The proof of exemption from the broadcaster is the transmission of the speech that the former president made yesterday and today. It is also proof of its exemption. be the target of attacks from the extremes of the political spectrum today, so radicalized. Globo does serious journalism and will continue to do so without being intimidated and never losing its serenity. "
Sentenced in two Lava Jato actions, the former president was released on Friday, the day after the Supreme Court decided, by 6 votes to 5, that a convicted person can only be arrested after the final judgment (the end of resources). This has changed the case law that, since 2016 , has allowed the arrest soon after the second instance conviction.
The Supreme Court decision, one of the most awaited in recent years, has the potential to benefit about 5,000 prisoners, according to the National Council of Justice (CNJ). Brazil has a total of approximately 800,000 prisoners. Lula, fellow petista José Dirceu and toucan Eduardo Azeredo have already been released.
Lula spent 580 days in jail on conviction on charges of accepting ownership of a triplex in Guarujá as a bribe paid by OAS in exchange for three contracts with Petrobras, which he has always denied.
This conviction, after denunciation of the Lava Jato of Curitiba task force, was signed by the then judge Sergio Moro in the first instance, the confirmation of the Federal Regional Court in the second instance and the ratification of the Superior Court of Justice (STJ), which established penalty of 8 years, 10 months and 20 days.
As there are still appeals, the case has not yet become final, and Lula has been released.
The petista has also been convicted, so far only at first instance, in the case of the Atibaia ranch. According to the court ruling, also after Lava Jato's complaint, he received undue advantages from contractors Odebrecht and OAS in exchange for favoring companies in Petrobras contracts.
The renovations and improvements made by the construction companies in the site frequented by Lula constituted the practice of corruption and money laundering crimes. Under current rules, Lula is considered to be a dirty card, due to at least one conviction in the second instance — the Clean Record Law's court rule.
In the coming weeks, the Second Panel of the Supreme Court will judge a habeas corpus in which the defense of Lula maintains that Moro, now Justice Minister of Jair Bolsonaro (PSL), acted without the necessary impartiality in the process of the Guarujá triplex.
Based on this, Lula wants the board to overrule the entire process . This is the defense's most important judgment today , since without this conviction Lula could become eligible, at least for now.

Political center sees no end of the world with Lula (November 11th)
Despite increasing intensification of radicalism caused by Lula's departure from jail, not all center leaderships consider the polarization to be maintained in future elections. A good thermometer were the only simple street demonstrations against and in favor of the petista on judgment day. “The social media landscape is not being a true copy of real life. My impression is that PT and the government (Bolsonaro) are balancing on each other's shoulders, but things are calming down, ”says former governor Paulo Hartung.
Hartung, former governor of Espirito Santo state, acts today as one of the center's main articulators, and is a close friend of Luciano Huck .
He has been approaching House Speaker Rodrigo Maia (DEM-RJ) and is helping to consolidate the social security reform proposed by the Hosuse Speaker.
For Hartung, even with Lula radicalizing the discourse, the share of dissatisfied people who, in the 2018 election, opted for a useful vote will be growing in society.
In Sao Paulo, toucans (as PSDB members ar knwon) are not so optimistic in the short term. They consider that Lula's return to the daily ring of public debate favors, besides the names of the PT, the candidates for mayor to the right of Bruno Covas (PSDB).

'Lula is free, but still has all his crimes on his back,' says Bolsonaro (November 11th)
A day after the release of former President Luiz Inacio Lula da Silva from the prison in Curitiba, where he was since April 7 last year, President Jair Bolsonaro criticized the petista when leaving the Alvorada Palace (Official Residence) on Saturday, 9 , to attend a barbecue party in the Army sector of Brasilia. "Lula is free, but he keeps all his crimes on his back," said Bolsonaro. "The vast majority of the Brazilian people are honest and hardworking, we will not make room or compromise for a prisoner," he said.
Late on Saturday night, the president wrote in his Twitter account that he will not respond to "criminals who are currently at large" in a reference to Lula. Bolsonaro shared with the text an image with the cover of the Saturday edition of Correio Braziliense newspaper. The image shows the former petista president with his right arm raised, celebrating, alongside co-religionists such as PT president, federal deputy Gleisi Hoffmann (PT-PR) and former mayor of São Paulo and Bolsonaro's opponent in the 2018 elections, Fernando Haddad. In Bolsonaro's publication, Haddad is highlighted, with a red circle around his head.
Earlier, through social networks, Bolsonaro had already attacked Lula, but indirectly, not to mention the name of the former president or any political opponent. "Lovers of freedom and good, we are the majority. We cannot make mistakes," he said on Twitter. "Without a north and a command, even the best troop becomes a (sic) gang that shoots everywhere, including friends. Don't give ammunition to the bastard, who is momentarily free but guilty," he says.
In a second tweet, the President of the Republic writes: "We have started (sic) a few months the new phase of Brazil's recovery and it is not a fast process, but we have advanced with facts". And repeat: "Do not give ammunition to the bastard, who is momentarily free but charged with guilt."
In both posts, Bolsonaro avoids any direct mention of political opponents who gained freedom after the Supreme Court (STF) decision to overturn the prison after the second instance conviction. However, on leaving Dawn, he made it clear that the posts were about Lula. “I already made a comment on my social media today and there will be another one in the afternoon,” he said when asked about the release of the former president.
Earlier, Bolsonaro had received a visit from his son Senator Flavio Bolsonaro (PSL-RJ) and also from the Minister of Institutional Security, General Augusto Heleno.

Situation in Bolivia (November 11th)
Brazil is aware of the results of the Electoral Integrity Analysis of the October 20 General Elections, conducted by the Organization of American States (OAS), and expresses deep concern about the serious irregularities pointed out there, which disqualify the election and lead to the need for convocation. of a new electoral process.
Brazil considers it pertinent to convene new general elections in response to the legitimate manifestations of the people and the recommendations of the OAS, after the serious irregularities have been noted.
Brazil estimates that the new suffrage must be endowed with all conditions to ensure its absolute transparency and legitimacy. In this sense, the new suffrage must be presided over by authorities recognized for their honor and credibility to guarantee the sovereign desire of the Bolivians, and to count on international observation at all stages of the process.
