1. Eligible applicants and place of application
1) Eligible
- Dual-national males who failed to perform military service and did not report their renunciation of nationality within the report period for renunciation of nationality (by March 31 of the year they turn 18) and meet all of the following requirements
- A person who was born abroad or immigrated abroad when he/she was a child under six years old and has a main basis of life in a foreign country continuously
- A person who has a legitimate reason for not reporting his/her renunciation of nationality within the report period for renunciation of nationality (by March 31 of the year he/she turns 18)
2) Place of application: Overseas diplomatic mission with jurisdiction over the address (not available in Korea)
2. Required documents
1) Application form for exceptional renunciation of Korean nationality (form, attach one photo)
2) Information on the effects of renouncing (losing) Korean nationality (form)
3) Certificate of foreign residence (form)
4) Email Transmission Consent Form (form)
5) Original and copy of US birth certificate
6) Original and copy of US passport
7) Applicant's basic certificate, family relationship certificate
8) Parent(s)'s basic certificate
※ If there is no basic certificate or family relationship certificate, submit a certificate of removal from the register (제적등본)
→ 7~8) certificates can be issued by the consulate.
(The fee is $1 per copy in cash, and you also need to know your place of origin(등록기준지, 본적지) and resident registration number(주민등록번호) to apply for the certificate.
9) Documents proving the parent's permanent residency purpose (exempt for female applicants)
• If you are a US citizen: original and copy of US citizenship certificate
• If you are a permanent resident: original and copy of green card
• If you have applied for permanent residency: original and copy of green card receipt
• If your parent(s) have resided in the US for more than 17 years continuously after your birth: official documents proving this fact (e.g., tax reports, child's school records, etc.)
※ If the parents are American rather than Korean, submission of the parents' American passport or birth certificate.
10) Documents and translations proving that you have been living mainly abroad since birth or before the age of six (documents that can verify the actual address of the applicant and parent(s), etc.)
11) Documents and translations proving that there are circumstances that make it difficult to hold the applicant responsible for not reporting the renunciation of nationality within three months of being assigned to the reserve forces
12) Documents and translations proving that you have significant restrictions or disadvantages in choosing a career abroad due to dual nationality
13) Documents and translations proving the contents of the application form for exceptional renunciation of Korean nationality in relation to the qualifications and considerations for the application and approval of exceptional renunciation of Korean nationality under Article 14-2 of the Nationality Act
14) identity verification certificate (if the name on the Korean family relationship certificate and the US birth certificate are different) (form)
15) Military service certificate or other documents proving the performance of military service obligations (Please click here)
16) Fee: $90 (we can only accept cash or money order)
17) Envelope and stamp for reply (recommended to submit with USPS PRIORITY/EXPRESS MAIL or higher)
3. Precautions
- Expected processing time: about 18 months (Please understand that it may vary depending on the progress of the Ministry of Justice.)
- Reservation required when visiting (Please click here to go to the reservation)
- Documents issued abroad among the application documents must be attached with the confirmation of Apostille by the national government or the consular confirmation by the Korean diplomatic mission in the host country.
- If the documents submitted in relation to the application are written in a foreign language, a translation must be attached, and the name and contact information of the translator must be stated in the translation.
- In the process of examination by the Ministry of Justice, if additional matters are needed after examining the requirements for application, the facts claimed, and the evidence, the applicant will be requested to supplement by email through the overseas diplomatic mission where the application was submitted, so please enter your e-mail address correctly.
- If the applicant falls under Article 14-2 (2) of the Nationality Act or Article 28 (2) of the Enforcement Decree of the Nationality Act, the Minister of Justice may refuse the application without referring it to the Nationality Deliberation Committee.
