♣ Loss of nationality means that a Korean national who was born abroad by his/her father or mother who is a Korean national (dual national) renounces his/her Korean nationality with the permission of the Minister of Justice.



♣ According to the revised Nationality Act implemented on May 24, 2005, a male who was born abroad by his/her direct ascendant (parent) who resided abroad without the purpose of permanent residence must perform or be exempted from military service in order to renounce his/her nationality.


♣ If the father or mother is a permanent resident or a citizen, if he/she is applying, if the father or mother has resided in the country for more than 17 years after the birth of the child, a male who does not report the loss of nationality by March 31 of the year he/she turns 18 must be exempted from military service in order to renounce his/her nationality. A person who is 15 years of age or older must visit the overseas diplomatic mission and sign the application form himself/herself, and a person who is under 15 years of age must report by his/her legal representative.



1. Concept and meaning of the term

It means that a dual national who acquired Korean and foreign nationality at birth renounces his/her Korean nationality.
(For example, when one or both of the parents are Korean nationals and born in the United States)

Loss of nationality report is only possible by visiting (reservation required in advance), and mail report is not possible. (Please click here to go to the reservation)

※ A person who is 15 years of age or older must visit and apply in person. (Parents cannot apply on behalf of the person)  

※ Cases where Korean nationality is acquired at birth

•   Those born after June 14, 1998: A person whose "father or mother" had Korean nationality at the time of birth acquires Korean nationality at birth. (Principle of bilateral bloodline)

•   Those born before June 13, 1998: A person whose "father" had Korean nationality at the time of birth acquires Korean nationality at birth. (Principle of paternal bloodline)  

※ If the parent(s) of the person who renounced his/her nationality were Korean nationals and acquired US citizenship without reporting the loss of nationality, they need to report the loss of nationality.

You can submit your parent(s)'s loss of nationality report(국적상실) together when you come to submit your child's loss of nationality(국적이탈).



2. Required documents and fee information


1) Loss of nationality application form (form)

•  Attach one photo taken within the last 6 months (3.5cm x 4.5cm or 2inch x 2inch) to the application form, you must bring a printed photo as the consulate does not take pictures.

•  Date of acquisition of Korean nationality for dual nationals: Enter the date of birth on the family relationship certificate, check "birth" for the reason of acquisition
•  Date of acquisition of foreign nationality for dual nationals: Enter the date of birth on the US birth certificate, check "birth" for the reason of acquisition
•  Enter your Korean name in the reporter section at the bottom and sign (If under 15 years old, enter the name of one of the parents and sign by one of the parents, if over 15 years old, enter the name of the reporter and sign by yourself)

3) Certificate of foreign residence (form)

•  Date of birth: Enter the date of birth registered in Korea•  Passport number: Enter both the valid US passport and Korean passport numbers (If you do not have a Korean passport, you do not need to enter the Korean passport number)
•  Foreign residence period: Enter the period of residence in the US as "~ years ~ months"•  Purpose of use: Enter "loss of nationality"
•  Enter your Korean name in the reporter section at the bottom and sign (If under 15 years old, enter the name of one of the parents and sign by one of the parents, if over 15 years old, enter the name of the reporter and sign by yourself)



4) Certificate of identity (form) (if the name on the US birth certificate and the Korean basic certificate are different)

•  Enter the information registered in Korea in the left "Family relationship registration part registration details"
•  Enter the information registered in the US in the right "Foreign registration details" (Enter the US passport number in the resident registration number field)
•  Enter "birthday" for the date of nationality acquisition
•  Enter your Korean name in the reporter section at the bottom and sign (If under 15 years old, enter the name of one of the parents and sign by one of the parents, if over 15 years old, enter the name of the reporter and sign by yourself)
•  Enter the name and signature of the parent(s) in the verifier 1 & 25) Original and copy of your US birth certificate (issued by county) 1 copy

 

5) Email Transmission Consent (form)


6) Original and copy of your birth certificate

 


7) Original and copy of your valid US passport

 


8) Your basic certificate (detailed) and family relationship certificate (detailed) 1 copy each (original issued within the last 3 months, disclosure of the last digit of the resident registration number) → Can be issued by the consulate

 


9) Basic certificate (detailed) of your parent(s) each 1 copy (original issued within the last 3 months, disclosure of the last digit of the resident registration number) → 8~9) certificates can be issued by the consulate.

10) Parent(s)'s foreign permanent residence purpose proof document

•  If the parent(s) is a citizen: Original and copy of the US citizenship certificate
•  If the parent(s) is a permanent resident: Original and copy of the valid US permanent resident card
•  If the parent(s) is applying for permanent residence: Original and copy of the immigration receipt for permanent residence application ((I-485)
•  If the parent(s) has resided in the US for more than 17 years after the birth of the child, the original and copy of the official document proving the fact (if the parent(s) is not a permanent resident or a citizen)

※ If one of the parents is not of Korean descent, submit the birth certificate and passport of the person

 

11) Fee: $ 18.00 (cash or money order only)

 


12) Return envelope, stamp (size does not matter)

※ It is recommended to submit an envelope and stamp of USPS Priority Mail or higher grade that can track delivery for receiving the result

(Regular letter envelope, stamp is fine, but recommended for faster receipt)

※ If the person who reports is 'female', the parent(s)'s permanent residence purpose (document 9) document is optional.



3. Expected processing time and notes

1) Expected processing time: about 18 months (Please understand that it may vary depending on the progress of the Ministry of Justice.)

2) The reporter himself/herself (15 years of age or older) must visit (If under 15 years of age, the legal representative (father or mother) must visit and apply)

3) Only possible by visiting, mail report not possible

•  Reservation required when visiting (please click here to go to the reservation)

4) A male must apply before March 31 of the year he turns 18.

5) A male who wants to report after April 1 of the year he turns 18 must submit a document (issued by the Military Manpower Administration) proving that he has performed, been exempted, or joined the second national service: Military service certificate or resident registration copy (must be an original issued within 3 months)
