제목 : 시민적․정치적 권리 규약 위원회 일본 보고서 심의 최종의견서 공개

1. 시민적․정치적 규약위원회(일명 B규약위원회)는 7.15(화)-16(수)간 일본의 제6차 보고서를 심의하고, 7.24(목) 동 심의에 대한 최종의견서(Concluding Observations)를 공개하였다.

※ 시민적․정치적 규약 위원회는 임기 4년의 18명의 위원으로 구성, 시민적․정치적 규약 당사국들의 규약 이행 관련 사항을 심의, 필요한 권고 제시

2. B규약위원회는 이번 최종의견서에서 “위안부” 문제 관련, 많은 경우에 있어 모집, 이송 및 관리가 본인들의 의사에 반하여, 군대나 군대를 대신한 기관에 의한 강제와 협박을 통해 이뤄졌다고 하는 반면, 이들이 강제로 이주(forcibly deported)된 것이 아니라고 주장하는 일본의 모순된 입장에 우려를 표명하고, 이러한 피해자의 의사에 반하여 이뤄진 모든 행위들은 일본의 직접적인 법적 책임을 야기하는 인권침해로 간주되기에 충분하다고 밝혔다.

The Committee is concerned by the State party's contradictory position that the "comfort women" were not "forcibly deported" by Japanese military during wartime but that the "recruitment, transportation and management" of these women in comfort stations was done in many cases generally against their will through coercion and intimidation by the military or entities acting on behalf of the military. The Committee considers that any such acts carried out against the will of the victims are sufficient to consider them as human rights violations involving the direct legal responsibility of the State party.

3. 또한, B규약위원회는 일본정부가 즉각적이고 효과적인 입법 및 행정 조치를 통해 △전시 일본군이 “위안부”에 대해 자행한 성노예 행위 및 여타 인권침해 주장을 실질적이고 독립적이며 공정하게 조사, △피해자 및 그 가족들에 대한 사법적 접근 보장 및 완전한 배상 실시, △모든 관련 증거 공개, △교과서 수록 등 학생들과 대중들에게 교육 실시, △공개 사과 및 책임 공식인정, △피해자를 모독하거나 위안부 문제를 부인하려는 모든 시도 규탄 등을 촉구하였다.

The State party should take immediate and effective legislative and administrative measures to ensure: (i) that all allegations of sexual slavery or other human rights violations perpetrated by Japanese military during wartime against the "comfort women", are effectively, independently and impartially investigated and that perpetrators are prosecuted and, if found guilty, punished; (ii) access to justice and full reparation to victims and their families; (iii) the disclosure of all evidence available; (iv)education of students and the general public about the issue, including adequate references in textbooks; (v) the expression of a public apology and official recognition of the responsibility of the State party; (vi) condemnation of any attempts to defame victims or to deny the events.

4. 이밖에도 한국 등 소수자에 대한 혐오발언(hate speech), 극단적인 집회, 괴롭힘, 폭력에 대한 우려를 표명하면서 △인종적 우월성을 옹호하고 차별, 적대 및 폭력을 부추기는 모든 종류의 선전 및 시위 금지, △인종주의에 대한 인식제고를 위한 충분한 재원 배분 및 혐오와 인종주의적 범죄 관련 대응을 강화하기 위한 법집행 인력에 대한 훈련 강화, △인종주의적 공격 예방, 관련자 조사 및 처벌 보장 등을 권고하였다.
